P R E A M B L E

We, the war veterans who have fought for the right of self-determination of peoples and so that mankind might live in peace and dignity, resolve to unite in order to actively contribute to the realization of the aims which the Western Cape Armed Forces Veterans has thus formulated in its Charter:

 

  1. To maintain National peace and security, and , to that end: to take effective collective measures for the prevention and removal of threats to the peace and for the suppression of acts of aggression or other breaches of the peace, and to bring about by peaceful means, and in conformity with the principles of justice and international law, adjustment or settlement of international disputes or situations which might lead to a breach of the peace;

 

  1. To develop friendly relations among veterans within South African provinces, based on respect for the principle of equal rights and self-determination of peoples, and to take other appropriate measures to strengthen universal peace;

 

3 To achieve national and  international cooperation in solving national and international problems

of an economic, social, cultural or humanitarian character, and in promoting and encouraging respect for human rights and for fundamental freedoms for all without distinction as to race, sex, language, or religion; and

 

  1. To be a centre for harmonizing the actions of Military Veterans within the Western Cape in the attainment of these common ends.

CHAPTER 1

GENERAL STIPULATIONS

Article 1 Name of the organization

1) The name of the organization shall be “Western Cape Armed Forces Veterans” (henceforth referred to as: WCAFV).

2) The WCAFV is a NATIONAL non-profit, non-governmental organization which is independent from governments, non-political and non-sectarian. It does not discriminate on the basis of racial, ethnic, religious, gender, nor does it allow its members to do so.

Article 2 Aims

The aims of the WCAFV are:

  1. a) to defend the spiritual and material interests of veterans and victims of war and their families by all available legal means;
  2. b) to promote national peace and security by the application to the letter and in the spirit of the Charter and by respecting the human rights and fundamental freedoms set forth in the International Bill of Human Rights and other international instruments;
  3. c) to promote the full reintegration of veterans and victims of war in their respective communities by campaigning for the provision of appropriate rehabilitation and other relevant legislation and actions to overcome the physical and psycho-social consequences of armed conflict;
  4. d) to further friendly relations among national as well as international organizations of veterans and victims of war;
  5. e) to encourage cooperation and partnership between national organizations and/or institutions and the exchange of expertise and experience in all fields of common interest;
  6. f) to promote and maintain the sacred duty of historical remembrance, both national and shared, and to spread its values and its profound significance among all sectors of society so as to establish understanding, rapprochement and solidarity amongst peoples.

 

Article 3 Seat of the organization

The seat of the WCAFV is located in Cape Town, South Africa .

It may, following due legal process, be transferred to any other location upon a decision by the Executive Board.

 

CHAPTER 2

MEMBERSHIP

Article 5: Criteria and application for membership

1) National and international veterans of war as defined in the Rules may apply for ordinary membership.

2) Legally instituted organizations and corporate bodies which support the aims and objectives of the WCAFV may be invited to join the WCAFV as associate members.

Article 6: Responsibilities and rights of members

1) Members agree to subscribe to this Constitution and its Rules, and pledge themselves to adhere to the aims, objectives and principles of the WCAFV as long as they are members.

2) Ordinary members have full membership rights.

3) Affiliate members may attend meetings by invitation, may be given the right to speak at meetings, but have no voting rights.

Article 7: Admission

1) Ordinary membership of the WCAFV may be conferred by the Vetting Team on presentation of the application by the Executive Council.

2) Affiliate membership of the WCAFV may be conferred by or  upon proposal by the Executive Council.

Article 8: Withdrawal

An ordinary member may decide to withdraw from the WCAFV at any time, but shall not be entitled to any reimbursement of any sort. The Database Administrator shall notify the Executive Board, in writing, of such a decision within 72 hours.

Article 9:  Certification

1) Members will only receive certification after attending at least 2 General Meetings and will be officially inducted at the following WCAFV Official Major Parade which will be held every quarter as defined by the Executive Council.

Article 10: Suspension and expulsion

1) If an ordinary member or organization fails to comply with the WCAFV’s constitution, or behaves in a manner likely to bring the WCAFV into disrepute, a motion for its suspension may be set down for consideration by the Executive Council. The organization involved will be advised about such a notion and it will be afforded the opportunity to be represented at the relevant meeting of the Executive Council to show cause why the suspension should not be effected. If it fails to do so the Organization shall be suspended from the WCAFV by a two-thirds majority vote of the Executive Council, which may lift the suspension by a similar majority vote at its discretion.

2) After a member organization has been suspended for a period of three consecutive years the Executive Council will discuss a proposal of permanent expulsion.

3) An ordinary member may be expelled for good cause from the WCAFV upon recommendation of the Chapter Leaders to the Executive Council. To be approved the recommendation must be passed by at least 75% majority of the Executive Council. The ordinary member concerned shall be permitted to present his/her case before the Executive Council.

 

CHAPTER 3

RESOURCES

Article 11 Financial resources

The financial resources of the WCAFV include:

  1. a) No member funds will be required from any member of the WCAFV. Membership will always remain free until otherwise decided by the Executive Council of the WCAFV. For such a notion to be passed there must be at least a 90% vote in favor by members of the Executive Council of the WCAFV.
  2. b) all legally authorized public and private subsidies;

c ) income from investment

  1. d) any other resources not prohibited by law

 

CHAPTER 4

ORGANIZATION

Article 12: Elements of the organization

1) The organization of the WCAFV consists of the following permanent elements:

  1. a) A Chairman;
  2. b) A Vice Chairman;
  3. c) An Executive Council;
  4. d) Regional Standing Committees;
  5. e) Financial Committee.
  6. f) Standing Committee on Women and Youth

 

CHAPTER 5

Executive Council

Article 13 Composition

1) The Executive Council shall be composed from the ordinary members of the organization.

5) The members of the Executive Board shall attend all meetings as set out by the Board as agreed and they may participate in the deliberations of the WCAFV.

6) Affiliate members may be invited to attend the meetings of the Executive Council, they may be given the right to speak by the Chair, but they cannot vote.

Article 14 Authority and functions

1) The Executive council is the supreme authority of the WCAFV. It shall be responsible for the achievement of the aims of this Constitution and shall deal with matters of interest to the WCAFV, in accordance with the provisions set forth therein.

2) It shall elect the Chairman, the Vice Chairman, the Treasurer and the members and alternate

members of the Financial Committee, who shall remain in office until the end of the next meeting of the Executive Council.

It shall further ratify the ex officio appointment of the Chairpersons of the Regional Standing Committees and the Chairperson of the Standing Committee on Women as Vice Presidents of the WCAFV, who shall remain in office on the Executive Board as long as they hold their posts as Chairpersons.

3) It shall adopt the audited accounts of the WCAFV and approve the forecast budget for the next 3 years.

4) It shall set the scale of the membership dues for the following years on proposal from the Executive Board.

5) It may decide to confer honorary titles upon the recommendation of the Executive Board.

Article 15 Meetings- Executive Council

1) The Executive Council shall meet at least once every calendar  month in ordinary session.

2) General member and associate members meeting will be held on the 1st Wednesday of every month at a venue to be decided by the Executive Council.

4) Extra-ordinary meetings may be held upon the decision of the Executive Board or at the request of ordinary members representing the WCAFV. A request for the holding of a special meeting must be filed with the Executive Council at least 72 hours in advance of the desired date of the meeting.

 

CHAPTER 6

FUNCTIONS AND RESPONSIBILITIES OF THE

MEMBERS OF THE EXECUTIVE BOARD

Article 16: The Chairman

1) The Chairman shall convene and preside over the meetings of the Executive Board and over the Regional Standing Committees and all members.

2) He shall represent the WCAFV, as appropriate. In particular, he shall have the authority to represent the WCAFV in all civil acts and to go to court in the name of the WCAFV after legal consultation.

3) The Chairman may, within the constraints of the law, concede the delegation of powers necessary for the good functioning of the WCAFV.

Article 17 The Vice Chairman

1) The Vice Chairman shall assist the Chairman in the execution of his duties.

2) He shall deputize for the Chairman in the case of unavailability. In the case of the vacancy of this post, he shall assume the seat of Chairman until the next Executive Council Assembly.

Article 18: The Leaders of the Regional Standing Committees

1) Being Chairman of the Regional Standing Committee of his region of origin each Regional Leader shall be responsible for the functioning and activities of the relevant Regional Standing Committees. He shall convey to the Executive Board the points of view, concerns, needs and wishes of the Standing Committee and shall ensure their follow-up.

2) Regional Leaders  may represent the WCAFV and may be given specific tasks by decision of the Chairman or the Executive Council.

Article 19: The Secretary

1) The Secretary shall be responsible for the secretarial function of the WCAFV, in accordance with the relevant guidelines and decisions of the Executive Council.

2) He shall be responsible for the organization of the Secretariat, for the administration of the Federation and shall authorize expenditure within the limits of the budget approved by the Executive Council. In connection with such matters he shall make all relevant decisions, and sign all administrative documents with the co signature of the Chairman.

3) He shall be responsible for the Public Relations function of the WCAFV and to this end, shall have the necessary powers.

4) He shall assist the Treasurer  in the preparation of the budget.

Article 20: The Treasurer

1) The Treasurer  shall be responsible for the financial affairs in accordance with the relevant guidelines and decisions of the  Executive Council.

2) He shall be responsible for the preparation of the annual budget and for its presentation to the Executive Board for approval.

3) He shall be responsible for ensuring that statements of accounts of the assets of the WCAFV are kept. Furthermore, he shall ensure that the accounts are prepared for auditing .

4) He shall initiate appropriate action upon any recommendations of the Financial Committee.

Article 21: Remuneration

The members of the Executive Council shall not be remunerated by the WCAFV.

 

CHAPTER 7

THE FINANCIAL COMMITTEE

Article 22: Composition

1) The Financial Committee shall consist of two members elected by the Executive Council.

Article 23: Functions and activities

1) The Financial Committee falls under the Chairman and Vice Chairman.

2) It shall meet at regular meetings as defined by the Executive Council for the purpose of verifying and examining the audited financial accounts and financial report submitted by the Treasurer. It shall submit its report to the Executive Council in time before it is to be distributed to the member organizations.

 

CHAPTER 8

APPLICATION AND AMENDMENT TO THE CONSTITUTION

Article 24: Amendments to the Constitution

1) This constitution may be amended by the Executive Council by a majority of at least two-thirds of the votes cast.

2) Any proposed amendment, in formal draft and accompanied by supporting statements, shall be in the hands of the Executive Board, and shall be communicated by the Executive Board to the ordinary members once approved and passed.

 

CHAPTER 9

CONSTITUTIONAL RULES

Article 25: Purpose of and amendments to the Constitutional Rules

1) Rules for carrying out the provisions of this Constitution, called “Constitutional Rules”, shall be established by the Executive Council.

2) The Constitutional Rules may be amended by the Executive Council. All proposed amendments to these Rules shall be submitted to the Executive Council in accordance with the established procedures concerning the submission of resolutions.

 

CHAPTER 10

DISSOLUTION AND DISPOSITION OF ASSETS

Article 34 Dissolution and disposition of assets

1) Dissolution of the Federation may be proclaimed only by a four-fifths majority of the delegations registered at an Extraordinary meeting of the Executive Council convened for that purpose.

2) The Executive Council will decide on the disposition of the net assets and designate one or more liquidators responsible for carrying out the liquidation.

3) The Executive Council shall make the decisions concerning the disposition of the assets, which shall be transferred to one or more non-profit organizations whose aims are similar to those of the WCAFV.
